Estos Terms of Service (los “Términos”) constituyen un contrato entre Vargo (“Vargo”, “nosotros”) y la persona o empresa que contrata o utiliza la plataforma Vargo (el “Cliente”, “tú”). Al crear una cuenta, contratar un plan o utilizar la plataforma, el Cliente acepta estos Términos.

1. The platform

Vargo is an operations-management platform that brings together, among other things, sales and CRM, point of sale, inventory, projects, omnichannel support, accounting, expenses, automation and analytics modules. We provide the service as software as a service (SaaS): the Customer accesses it through the web and the mobile apps, with no need to install their own servers.

2. Accounts and Customer responsibilities

The Customer is responsible for the accuracy of its registration data, for managing the users it authorizes, and for keeping its access credentials confidential. The Customer agrees to use the platform in accordance with the law, not to infringe on the rights of third parties, and not to take any action that compromises the security, integrity or availability of the service.

3. Plans, pricing and billing

Subscriptions are sold by plan and by number of users. The account is activated with the first payment, processed through our payment provider. Billing can be monthly or annual depending on the plan chosen, and it renews automatically at the start of each period unless cancelled beforehand. Prices may be updated; any change will be communicated with reasonable advance notice and will take effect from the next renewal onward. Amounts paid are non-refundable unless applicable law provides otherwise.

4. Customer Data

La información que el Cliente y sus usuarios cargan en la plataforma (“Datos del Cliente”) es y sigue siendo propiedad del Cliente. Vargo processes Customer Data solely to provide and improve the service, in accordance with these Terms and the Privacy Policy. The Customer may export its data for as long as the contract remains in effect.

5. Intellectual property

The platform, its code, design, trademarks and documentation are the property of Vargo or its licensors. These Terms do not transfer any intellectual property rights to the Customer; only a limited, non-exclusive, non-transferable license to use the platform for as long as the contract remains in effect is granted.

6. Availability and support

We work to keep a high level of service availability and offer support through the channels listed on each plan. We may carry out scheduled maintenance, aiming to minimize its impact and giving notice whenever a significant interruption can be foreseen.

7. Third-party services and integrations

The platform may integrate with third-party services (for example, messaging, payments or analytics tools). Use of those services is governed by their own terms, and Vargo is not responsible for how they operate or for their practices.

8. Suspension and termination

We may suspend or cancel access for non-payment, misuse, or breach of these Terms. The Customer may cancel at any time from its account; cancellation takes effect at the end of the current billing period. After termination, Customer Data is retained for a reasonable period for export and is then securely deleted.

9. Limitation of liability

El servicio se presta “tal cual” y “según disponibilidad”. En la medida permitida por la ley, Vargo will not be liable for indirect or incidental damages or lost profits. The total cumulative liability of Vargo arising from the contract will not exceed the amount paid by the Customer in the twelve (12) months prior to the event giving rise to the claim.

10. Changes

We may update these Terms to reflect changes in the platform or in applicable regulations. We will publish the current version on this page, noting the date. Continued use of the platform after an update means you accept it.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Guatemala. Any dispute will be submitted to the competent courts of Guatemala City, unless applicable consumer-protection regulations provide otherwise.
